Mental Health Billing & Coding Alert
Psychiatric diagnostic evaluations and evaluation and management (E/M) visits often involve overlapping clinical work, which makes psychiatric evaluation and E/M billing a frequent source of denials. Under CMS’s National Correct Coding Initiative (NCCI), CPT 90791 and 90792 cannot be reported with office E/M codes 99202–99215 on the same date of service by the same provider. Understanding these restrictions helps psychiatry practices prevent duplicate billing and maintain accurate claims.
How CPT 90791, 90792, and E/M Services Differ
CPT 90791 covers psychiatric diagnostic evaluations without medical services. It covers psychiatric history, mental status assessment, diagnostic formulation, and treatment planning.
CPT 90792 includes psychiatric diagnostic evaluation with medical services, such as medication assessment prescribing, or a focused physical exam..
Office E/M codes 99202–99215 cover qualifying medical visits, including psychiatric medication management and treatment monitoring. Their levels are selected using applicable medical decision-making or time requirements, except where a code has different rules.

Medicare NCCI Restrictions on Same-Day Billing
The CMS NCCI Policy Manual (Chapter XI, Section C, rev. 1/1/2026) states that E/M codes shall not be reported with 90791 or 90792. CPT guidelines also limit 90791/90792 to once per day and prohibit reporting them on the same day as an E/M service by the same individual.
Because 90792 already includes the medical evaluation work, billing an E/M code alongside it is unbundling.
Modifier 25 does not automatically override this restriction. Practices must verify the applicable NCCI procedure-to-procedure edit and modifier indicator before submitting separately reported services.
The most common same day denial: Psychotherapy on the same day: 90791 and 90792 also cannot be reported with psychotherapy codes 90832–90838 or crisis codes 90839/90840 on the same date. Interactive complexity (+90785) may be added to 90791 or 90792 when documentation supports it.
Case Study: Psychiatric Intake With Medication Management
Scenario: A psychiatrist evaluates a 42-year-old patient presenting with anxiety and insomnia. The visit includes psychiatric history, medication review, mental status examination, risk assessment, and development of a treatment plan involving prescription medication.
Coding question: Can the psychiatrist report both 90792 and 99204 because the encounter includes diagnostic evaluation and medication management?
Correct approach: Report CPT 90792 when the documentation supports a psychiatric diagnostic evaluation with medical services. Do not separately report 99204 for the evaluation work included in 90792.
Billing takeaway: Medication management performed as part of a psychiatric diagnostic evaluation does not independently justify an additional E/M claim.
When Different Providers See the Same Patient
Separate reporting may be permissible when different qualified clinicians provide distinct, medically necessary services on the same date.
For example, a psychologist may perform a psychiatric diagnostic evaluation while a psychiatrist separately evaluates an unrelated medical concern.
Before reporting both services, verify provider specialty, group affiliation, independent documentation, medical necessity, applicable NCCI edits, and payer-specific billing rules.
Different providers or separate notes alone do not guarantee that both claims are payable. Medicare, Medicaid, and commercial payer requirements must be evaluated individually.
